Texans Can Fulfill Texas’ Promise to Students

Making education in Texas the best in the nation by Texans working hand-in-hand with education leaders in fulfilling Texas’ lawful promises to students and taxpayers:

  • Each, and ALL, students experience learning to realize their potential and

  • Effective use of communities’ and taxpayers’ resources.

Promise – Opportunity for Texas School Board and Superintendent Teams

For decades, the State of Texas and Local ISDs made promises in Texas’ own Education Code and in Local ISD’s own Policies to govern education for their students’ sake. School board and superintendent teams’ OPPORTUNITY to provide leadership in and management of Continuously Improving community-based planning and action, (PDSA) Plan-Do-Study-Act cycle:

  • Understanding and serving the needs of Each, and ALL, students, including special students and suicide prevention. Each student realizing their potential,

  • Making effective use of community resources, including time, talent, facilities and money-taxed and donated and

  • Authentically involving students, parents, teachers, and community members in the planning, decision-making, and action process for the students’ sake.

Promise – Opportunity for Texas School Lawyers

This is to share our hope for, and trust in, the following Creed and Rules coming alive through lawyers.

Coming alive in helping improve lawfully governing education for our students’ sake, the future of Texas.

 The Supreme Court of Texas, in their 1989, affirmed in 2013, Texas Lawyer’s Creed (Creed), and the State Bar of Texas, in their 2022 Texas Disciplinary Rules of Professional Conduct (Rules) – for lawyers, provide school lawyers the opportunity to play their vital role in the preservation of society, see Rules. Opportunity to become part of solutions in fulfilling the lawful promises made to students by the State of Texas and Texas’ Local ISDs.

 We are sharing the following with Texas education/school lawyers. Pease pass along to other education/school lawyers.

 From Texas Disciplinary Rules of Professional Conduct – for lawyers

  • Lawyers, as guardians of the law, play a vital role in the preservation of society.

  • Obligation of lawyers is to maintain the highest standards of ethical conduct.

  • Lawyers insist that every lawyer both comply with its minimum disciplinary standards and aid in securing their observance by other lawyers. Neglect of these responsibilities compromises the independence of the profession and the public interest which it serves.

  • So long as its practitioners are guided by these principles, the law will continue to be a noble profession. This is its greatness and its strength, which permit of no compromise.

  • Lawyers provide a client with an informed understanding of the client's legal obligations.

  • In all professional functions, a lawyer should be competent.

 From The Texas Lawyer’s Creed

  • Members of our citizenry have looked to the ranks of our profession (lawyers) for leadership and guidance.

  • As members of a learned art we (lawyers) pursue a common calling in the spirit of public service.

  • Restore public confidence in lawyers profession.

  • Lawyers being part of the solution.

  • Lawyer is entrusted by the people of Texas to preserve and improve our legal system.

  • Lawyer will advise client regarding the availability of mediation, arbitration, and other alternative methods of resolving and settling disputes.

  • Lawyer is obligated to educate clients, the public, and other lawyers regarding the spirit and letter of this Creed.

  • Lawyer shall not … be influenced by mere self-interest.

  • Lawyers’ duty to provide objective and independent advice.

    Public Opinion Matters

  • The Creed provides for public opinion to help lawyers comply with the Creed.
    Students’, parents’, teachers’, administrators’, elected officials’, and taxpayers’ opinions about how school lawyers honor their Creed and follow their Rules is to be shared in public.

Why Improve Texas Education - See 20 Min. Video Below

Reasons for Texans learning and seizing their lawful opportunities for their students’ sake include:

  • Suicide and violence prevention in schools,

  • Each student realizing their potential,

  • Not wasting community resources, including time, talent and money (taxed and donated), on not serving the needs of students.

  • The Texas Legislature no longer spends time and money on writing new Bills for purposes, such as suicide prevention or community schools, that are already provided for in the existing Texas Education Code.

  • In 2018, the Federal government found the State of Texas in violation of Federal special education law. — All while Texas has its own laws for serving the needs of special education students that go unfulfilled.
